Strengthening inspection work and protecting workers' rights to limit strikes

On September 26, the People's Committee of Nghe An province reported on the 1-year summary of the implementation of Decision No. 29/2021/QD-UBND of the Provincial People's Committee on promulgating regulations on coordination in resolving strikes that do not comply with the prescribed legal procedures in the province.

From September 2021 to present,in Nghe An provinceThere were 6 worker strikes with the participation of 200 - 5,000 workers in Dien Chau, Nghi Loc, Yen Thanh districts and Vinh city. The strikes were caused by reasons such as the prolonged Covid-19 pandemic, affecting production and business activities, working conditions, and income stability of workers. Workers said that their rights were not guaranteed (such as requests for increased wages, bonuses, allowances, Covid-19 support regimes, attitudes of management departments...). Enterprises have not complied with the provisions of the Labor Code...

Upon receiving information about the strike, the Standing Committee of the Provincial Party Committee and the Provincial People's Committee promptly led and directed relevant provincial departments, branches and localities where the strike occurred to organize work, dialogue, negotiate and resolve the situation, not letting the situation become more complicated.

Provincial departments, branches and sectors have proactively and actively coordinated with district departments and sectors to quickly approach and organize work, negotiate and support the parties to resolve. Directly organize to understand the thoughts and aspirations of workers; at the same time, dialogue, propaganda, and explain specifically to workers each specific content so that workers clearly understand the provisions of the law and share with businesses to stabilize the situation, ensure security and order to gradually bring businesses into normal production and business activities. On the basis of dialogue, negotiation and work with businesses, the recommendations of workers have basically been resolved and all workers have returned to work, the production and business situation has returned to normal operations.

In particular, the Provincial Federation of Labor has directly worked with the Board of Directors of companies, directly dialogued with workers to understand the thoughts and aspirations of workers. At the same time, dialogued, propagated, explained to workers each specific content so that workers clearly understood the provisions of the law and shared with businesses to stabilize the situation, ensure security and order, mobilize workers to return to work and protect the legitimate rights of workers and laborers, gradually bringing businesses and production and business activities back to normal.

For prolonged strikes with a large number of workers participating, signs of spreading, and complicated security and order, the Nghe An Provincial Party Committee and People's Committee have promptly directed, and interdisciplinary teams have stepped in to quickly resolve and stabilize the situation.

The Provincial People's Committee also identified the key task in the coming time as continuing to strengthen the work of grasping the situation to proactively develop prevention and combat plans, avoiding surprises and passivity; stepping up inspection and examination of compliance with labor laws at enterprises, promptly detecting and handling violations of labor laws by enterprises, protecting the legitimate rights and interests of workers.

In addition, it is necessary to focus on building, enhancing the position, and affirming the unique role of grassroots trade union organizations, especially in enterprises with a large number of workers. Trade union organizations must create conditions for the establishment of grassroots trade union organizations. Strengthen training, foster knowledge, and improve the effectiveness of grassroots trade union activities in enterprises. Direct the trade union system to regularly grasp the legitimate and legal aspirations of workers and laborers; proactively propose to enterprises to promptly resolve them, and prevent strikes like in the recent past.
